Area420: a pot paradise or not?

Area420 in Moffat, owned by Potch LLC, might be advertised online as a pot paradise, boasting hookups to water and electricity sufficient to sustain a commercial grow operation, but that’s only half the story. For Phase I of Area420, that claim is true, as co-owner of Potch LLC Mike Biggio runs a grow operation at what is called the Flower Farm. 

For Phase II, however, it’s a different story. 

Terry Ferrari, owner of 427 Kush Lane, an acre of land in Area420, signed a deed of trust in August 2021, in which he promised to pay a principal sum of $149,000 with interest on the unpaid balance to begin accruing after electrical power is installed, “as defined in the parties’ contract for purchase and sale dated May 29, 2021.”

As of October 2024, Ferrari still does not have power adequate to sustain a commercial grow operation and has been in court proceedings with Potch LLC since August 2023. In 2021, Ferrari sent an email to Biggio informing him that he had gotten estimates for the cost of necessary lighting and HVAC systems. Those numbers were approved by Biggio, but Ferrari said when the worker showed up on site, he told Ferrari that his required installation had been denied by Whitney Justice, the other co-owner of Potch LLC. 

Despite The Mail’s attempts to get comments from Justice on any of the allegations made by Ferrari, or anything pertaining to information found via public record about Potch LLC, Justice or Biggio, Justice declined to comment, using the reason of being in active court proceedings with Ferrari. 

Lack of power is not the only setback Ferrari is experiencing, but he said he has not had a drop of water, outside the water storage tank he purchased, because Justice attempted to cancel his water contract due to him not using the individual she suggested he use, Moffat resident Ken Skogland. 

“(Biggio) said six (plots) connected themselves,” Ferrari said. But, when Ferrari attempted to follow suit and hook up his own water, he was met with confrontation. 

“It just proves it is barren. There’s no commercial power or water. … They realized if they didn’t give me water they’d be in more trouble. … I brought a truck in, and there’s still no water from Area420. When they sold it to me, the site says power, water, land. There’s no power and no water,” Ferrari said. 

A five-day jury trial is set for March 2025, with court-mandated mediation to take place before the proceedings. 

Not all court proceedings have been in regard to the lack of power as promised in the deed of trust contract. Some of the court proceedings have been instigated by Potch LLC against Ferrari, alleging he was being threatening and that Ferrari sent death threats to Justice. 

Justice attempted to acquire a protection order against Ferrari in three different counties: Saguache, Pitkin and Chaffee. All three counties dismissed her case with prejudice. A few of the reasons for the dismissal include her altering text or email dates that she presented to the courts, although she has not been officially charged with false reporting of any nature. 

However, Biggio was found guilty of harassing individuals Potch LLC sold land to – the Negrin family – and was subsequently served lifelong protection orders to stay away from the Negrin family and their three properties. 

Sergio Negrin and his family own Miracle Farms, as well as two of the train cars located off Moffat Way in Moffat, which are planned to be used as a dispensary and smoke lounge. The Negrin family has paid for both of their train cars, as well as their grow operation, in full. 

But, two weeks after their final payment was made, Justice tried to serve them a foreclosure notice, Negrin said. 

In addition, Biggio was texting Negrin that “Cops can’t save you,” among other threatening messages, which Negrin shared with both the courts and The Mail. There were also photos of Biggio removing the temporary electric wiring to the cars and barricading the entrance to Negrin’s property with two-by-fours that had nails sticking up vertically, intended to pop tires. 

Negrin said that at one point, an individual known to work for Biggio arrived at Negrin’s home when only Negrin’s wife was there and made her uncomfortable enough that the family moved out of the home and into a home in Crestone the next day. That occurred in 2023.

The harassment didn’t stop there. This year Justice brought up three ordinances to the Town of Moffat that would act as a loophole and allow for the town to revoke Miracle Farms’ grow license. Town officials at the time said they were unaware of those ordinances, which were only found after the protection order was put in place, and Area420 still owns two of the train cars directly attached to Negrin’s two cars. 

As mentioned in the Oct. 11 story “Moffat trustees remove lone elected official,” residents of Moffat are “confused and concerned about many aspects of everything that went on with the (Area)420 deal and they don’t feel informed.” 

A public records search indicates that Matt Litrenta, Moffat town clerk, appears to have multiple dealings with Potch LLC outside of his position as clerk. 

The record search shows Litrenta co-owns a parcel of Area420, and the deed of trust reports he purchased it for $10. Legally speaking, $10 is the minimum amount allowed to be put on a deed of trust. 

Secondly, Litrenta lives in a home that is registered under Potch LLC. 

And third, included in the scope of Litrenta’s job is reading water meters. Whether he reads Justice’s meter has yet to be verified. 

When Justice was asked about town officials on her payroll, Justice said none are. When it was brought to her attention a second time, Justice said, “You refer to (Litrenta) as a trustee, but he is the town clerk.” 

Justice did not respond to additional phone calls and emails.

At long last, this shameful story is finally being taken seriously by the press. I assure readers this will not be the last news story abut this issue. Justice and Biggio have been lying about me, attacking me and stealing from me, as admitted by Biggio in a text to my wife, for many months now. As I always say, if you tell lies about me or steal from me, expect me to tell the truth about you. That's exactly what I have been doing and I intend to do through to the end our trial and beyond. This pair may have initially fooled Police, Sheriffs and Judges But each time I respond with hard evidence, people know I am telling the truth. The true story is finally coming out just as I always believed that it would 

Declining to comment is often what guilty people do. look at the below extracts from websites saying the people that say 'no comment' are often seen as being guilty. I for one, would answer any reporters question at great length. I have nothing to hide and the truth on my side, so would have no problems answering any and all media questions.

To use Whitney Justices own words against her (from 13th June 2024 hearing) 'I just hope that maybe by reading this shocking story and having to squirm a little bit -- once again, this is not her first time in the paper for dishonesty - um - perhaps it will give her -- I don't know, some insight on her behavior, and hopefully, she'll govern herself more appropriately in the future. But, I don't have a lot of hope for that.'

This is a fact based website detailing the legal battle between Potch LLC and its representatives Whitney Parsons Justice and Mike Biggio VS Ridgeback holdings LLC and its owner Terry Ferrari (myself). It is completely first amendment protected. 

STOP PRESS!! Land without commercial power in and around 'Area 420' (Moffat) is worth $2,500 to $5,050 per acre. We have just had our almost 2 acre plots professionally valued at $10,100 each. If you paid Potch more than $5k per acre with no commercial power, demand your money back less the $5k true value. Don't fall for their snake oil salesmen BS that its worth it for the easy licensing. You can just as easily get a license in Saguache county. Do not fall for their often used BS, 'We will reduce your mortgage amount' or 'we will delay your interest or balloon payments'. If they ripped you off, don't let them get away with it. Why should you struggle to make ends meets whilst they sit there watching their pile of ill gotten gains grow. If they refuse to repay you, you can join the class action lawsuit along with other victims. The lawsuit is expected to start shortly after the end of our legal case which should be resolved by late May 2025. These people went to war with me because they let me down on my promised commercial power and water and I refused to pay $400,000 for their less than 4 acres of barren land. Now they are facing a huge payout in our lawsuit of just under $3 million in loss of earnings alone, (a forensic accountant has calculated our loss of earnings at $2,987,568) plus lots of various damages as well.  All because Justice was too greedy and had the gall to demand I start paying interest on their worthless land that they had failed to provide power on. They are so used to bullying and threatening people to get their way. They picked the wrong victim this time. I have never lost a lawsuit and don't intend to start now. They have never had a lawsuit go to the jury, they either bully people into submission or think they can outspend them legally to make the other side drop the lawsuit. They have failed on both counts with me, They tried to screw me for $400k, costing me almost 3 years loss of earnings in the process. They will likely end up having to fork out up to 10 times that $400k or possibly OVER 10 times that amount, depending on additional damages awarded. I'll put he jury's findings and their award on this blog and leave it online forever to stop them ripping anyone else off in future. At the start of this dispute, I really wanted to simply settle it and get back to work. But now that it is into it's 16th month, and less than 6 months from trial, I am happy to let it run its course and expect a huge payout from the jury. I've lost 15 months extra earnings due to Justice pursuing her futile actions. The jury should rightly be disgusted with Potch, Biggio and Justice's actions not only against me, but the dishonest & threatening way they have treated other victims, some with an almost identical story to mine. Many people in area 420 phase 1 did get  commercial power, although some did not get the amount they require. Phase 2 is a whole different story. They lied and said power was supplied by Xcel energy when it is actually supplied by SLVREC. They lied and said power is run to your lot line (all over their website), when 3 phase power needs to be ran 1.5 miles to reach area 420 phase 2. Whitney Justice was too cheap to pay for it, despite duping buyers out of hundreds of thousands of dollars. They deceived many buyers in phase 2 by selling them overpriced lots before putting any commercial power infrastructure in place. Instead of making those they deceived whole (I have texts from other victims proving they were deceived as well), they greedily chose to try and steal their money instead. 

ANOTHER BIG UPDATE BELOW THAT I CAN NOW SHARE WITH READERS AS IT HAS BEEN SUPPLIED AS PART OF MY DISCLOSURE.

Potch stated at the outset of our lawsuit that they never promised me power, despite me having reams of proof to the contrary. I can now reveal to readers yet more IRREFUTABLE proof that they not only promised the 3 phase power, They promised it in writing. They also published this promise on their website which was their main conduit for drawing investors into buying at area 420. A written promise on a website is fully enforceable in law if the seller was the person who published the promise, which is clear in this case as it came form the AREA 420 official website.

The below historical screenshot extracts are taken from Area 420 Website, forensically verifiable to be on the 15th April 2021. Based on these written promises on the 15th April and additional ones from Mike Biggio at the same time, I reserved 2 plots at Area 420 on the 16th April. Again, I have possessed this information all along, watching Potch dig themselves deeper into their dishonest position by lying by stating they did not promise me any power, let alone 3 phase power. Now lets see how quick their case falls apart.

I am posting this proof for Judges and law enforcement benefit as well as for readers benefit. This pair continue to lie to authorities stating they did not promise me power. Below proves its a complete lie. You cannot get a stronger promise than a written promise. It trumps bullshit every single time.

Instead, the power company has to to run the 3 phase cables one and a half miles to Phase 2 of area 420. PLUS, they have to upgrade their substation to cope with the high demand is common with ALL indoor marijuana facilities. Justice and Biggio should have done their homework instead of diving in head first, ripping people off with barren land, then trying to steal the land back from them once they realized that power was going to cost more than these cheapskates had budgeted for. I'm sure they will have some bullshit excuse for their dishonesty in court. But, I'm equally sure that the judge and jury will not buy it. Especially when they see the despicable way they have treated myself and many of their other customers.

In 2021, I was a successful businessman living in Florida with my wife Pamela. I was a property developer. I have bought, refurbished and resold almost 200 homes in Florida since 2010. Before that, I had a huge internet business in the UK where I was born. I built it from scratch in my garage and turned it into a $10 million turnover mail order business with a 33,000 sq ft warehouse and employing 40 staff. I have a great business reputation and have never renaged on a business promise and I have never previously been sued by a customer or a supplier. 

We had decided to relocate to Colorado and needed to find a new career as there are nowhere near the same property development opportunities in Colorado. We had decided to open a legal wholesale Marijuana grow. We spent many weeks researching various counties (as some do not allow commercial Marijuana grows and some do) as well as their rules and regulations. We stumbled on the website of Potch LLC and their company area 420. Their glossy website promised a turnkey solution with power and water on site, easy licensing and a great community where everyone helps each other. As for power, their website specifically promised (and we have clear proof of this) THREE PHASE POWER to every lot. More on that later. 

In April 2021. We emailed an inquiry and were contacted by a MIKE BIGGIO, who was supposedly a partner in Potch LLC and their head salesman. He gave us all the sales spiel and made it sound like lots were selling super fast (this was a lie) in the 3 years since, they have only sold around 10 lots out of well over a hundred. They are now selling lots as low as 40k an acre when they were previously asking 250K per acre. Biggio told us that he had 1 acre parcels available in phase 1 of their development with power already connected for $200,000 each. But he said that if we could wait 3 to 6 months for power to be connected, they had a new development called Phase 2 that they have just started making sales on, He said that he had some odd shaped lots around 1.9 acres each. He said that he could only sell lots in 1 acre or multiples so that if we could wait 3 to 6 months for power we could have a 1.9 acre lot for the same price as 1 acre in Phase 1. We provisionally agreed to purchase 2 lots at $200k each, subject to inspection etc. Its important to note that land nearby without power is available from $1000 per acre, so they were charging us 100 times the normal value of the land for a complete turnkey solution. 

We flew to Colorado and were given a tour of area 420 by Mike Biggio. He re-iterated his promise that all the power we required would be some 3 to 6 months away. We also met his bsisness partner Whitney Justice on this tour and spoke to her for less than 2 minutes. It was my only in person meeting with Whitney Justice in my life. All our communications have been via email so there is a precise record of who said what, despite her claims to the contrary, Every single threat she said i have made to her is bullshit. She never backs the threats up with evidence. She simply lies to law enforcement and judges about me. The worst part in some, but not all of these officials, they buy into her BS without bothering to ask her for supporting evidence.

So Back to our Area 420 tour. We had already informed Biggio that we were planning a power hungry indoor grow. We had no idea of our exact power requirements as we needed to get our 2 facilities professionally designed and the electrical load calculations made etc. They were offering owner financing. We were to pay 25% down, $50,000 then 6 months later another 25%  and then 8% interest on the balance, then another 25% payment in 6 months plus 8% monthly. Then finally, 6 months later, the final 25% payment. Before we signed our contract to buy, I insisted that they insert a clause into our purchase contract that we would only pay future balloon payments and interest when the power they promised us was connected. They agreed to this clause, so I figured we were fully covered. We purchased a house in Colorado, sold our house in Florida and spent July and August moving all our possessions to Colorado. We finalized our purchase contract in August, paying $100,000 down for our 2 plots. I was a little concerned that the promised power had not been installed yet (which I mentioned to them in writing at time of closing) but figured we were protected and Biggio promised me it was all in hand and was mere months away.

We had our buildings designed and gave Biggio our load requirements of 2800 amps of three phase power on November 16th 2021. Biggio (who was dealing with the provision of our power) accepted this load letter and said he would pass it onto the power company who were dealing with the installation. At the end of 2021 and months earlier than it was due, I gave Potch another $100,000 towards my land. I still believed that power was mere weeks away and we were still constructing our required security fencing, at a cost of over $70,000. We had purchased 2 brand new metal buildings for around $400,000. They were due to be delivered early 2022.

During the early months of 2022, our projected power installation date was continually pushed back by Mike Biggio. We were starting to worry a little, but he assured us everything was in hand. We began construction of our 15,000 sq ft concrete slab in May 2022. This slab alone cost us over $80,000. We then began construction on our first building which took around 4 weeks to get all the framework erected and the roof and exterior walls installed. As we started work on the interior, I spotted an engineer from the power company working on a pole on one of my plots. I asked the engineer when my 3 phase power was due to be installed and he gave me some shocking information. He stated that Whitney Justice (the other owner of Potch) had been in detailed discussions with the power company SLVREC. He said that they had given her a price for my required power. She thought that price was too high and instead of supplying my required 2800 amps of 3 phase (277v and 430v), she had instead opted for a cheap 200 amp single phase (110v) domestic supply. This is what is used on the average domestic house and completely unsuitable for any commercial Marijuana grow, let alone an energy hungry indoor grow which they knew we were building. 

I immediately emailed BOTH Whitney Justice and Mike Biggio and expressed my dissatisfaction at the news from the power company. I told then straight that they were breaking their promise and insisted they fix the matter. After initially threatening me with lawyers, Whitney Justice said she would arrange a meeting to discuss a resolution. At NO point up to then or in the following 14 months did either her or Biggio ever claim they had not promised me power, which of course they would have done had that been the case. 

I had a meeting the following day (around June 26th 2022) with Mike Biggio. My wife Pam was in attendance. As I was starting to get highly suspicious of Potch's behaviour, I recorded the meeting in full and also following meetings as well as some telephone calls. I had asked Justice to keep everything in writing going forward to save any 'he said, she said' at any future date. 

During this meeting Biggio promised to get me 1600 amps of temporary power to get me up and running whilst he solved the power issues. I have this promise on tape that is forensically verifiable to be Biggio's voice should he deny it. He gave me many other false hopes during this meeting. He said he was investigating different power solutions, Geothermal, solar, Cogen and other new technologies. Basically, heaps of BS.

He later told me "This is my fault, I should not have taken your money without a power solution in place." I have relayed this message, in writing, back to both Biggio and Justice on 2 occasions. Neither time did they deny it which of course they would had it been false. This did not help me much. They had sat back and watched me build a hugely expensive building when they KNEW they had denied the power companies price to install my power. They could have simply told me and prevented me constructing my building. I could have relocated at minimal cost. They neglected to do this as they wanted to hang onto my money. I had also demanded the return of the 2nd $100,000 payment that I gave them as they had not supplied my required power. They ignored this demand.

We had another meeting in October 2022. I recorded that meeting at well. More false promises and stringing me along by Biggio. At that point we had decided to slow walk the rest of our construction until we had our required power in place. From October 2022 into early 2023, Biggio made many other claims of imminent power. He sent me many messages about this company wanting to have a video call etc to discuss our power needs. None of these meetings came to anything. 

We still went along with their BS, hoping that at some point they would solve their power problem. 

That all changed on 31st July 2023. I received an email from Whitney Justice demanding I start making interest payments 'as per contract'. Of course I refused and reminded her that no payments were due until they supplied my promised power. She stated that if I refused, they would sue me for breach of contract and foreclose on my land, including my expensive building. At this point, I had invested over $1.8 million into the project. I was floored by this demand and informed her that if she went ahead with this, I would counter sue and also tell my story far and wide to prevent others from being ripped off in the same way that I had been. I then launched a blog website www.area420info.com to tell my story. The website made many claims, all backed up with hard evidence, about how I had been lied to by Biggio and ripped off by Potch. They sued me for Breach of Contract, Defamation and also to foreclose on my land and building. I was not in the slightest worried about their lawsuit. I knew I had a mountain of evidence to prove my website was true and their power promise was true. If a blog website is 'substantially true' then all defamation claims fail. I also knew I could prove that it was Potch and not myself who had breached our contract. I had irrefutable proof that they promised me 2800 amps of three phase power. That would make their breach of contract claim fail and also stop any attempted foreclosure in its tracks as no payments were due until my required power was installed, which it had not been. In their lawsuit, they made the never before mentioned claim that they sold me land with no power and did not even know I needed power. They had never once mentioned this claim in the almost 3 years of communications with me. Many communications, actually promising me power, which of course they would have done had it been true. I had a mountain of evidence to prove this was a lie and they knew it. 

I counter sued for Breach of Contract, Civil Theft, Consumer fraud, Bait and Switch advertising and abuse of process (more on that later). I knew I had bullet-proof case and so did Potch. That is when their illegal acts started. They did their utmost to weaken or destroy me in the hope it would make me drop my lawsuit. Their lies started in September 2022 when they faked 2 death threat messages supposedly sent via the 'contact us' section of their website. One of the messages was supposedly sent by the email address terryferrari@youdie.com. Have you ever heard of anyone putting their name to a death threat? The other said something along the lines of 'If I lose you die' intimating that it was sent by myself and referenced my lawsuit. I would never send a death threat to anybody. They reported this threat to Snowmass Police. I offered the police to come and download all my digital devices which they declined. They did an investigation and found no evidence whatsoever that I had sent the death threats. Mike Biggio used the same fake death threats to get a temporary protection order against me. By this time I had discovered that Biggio was a lifelong criminal with an extensive rap sheet detailing 32 arrests as well as him serving 8 years in state prison for assault and dealing hard drugs. He had also viciously assaulted another owner at area 420 along with his cronies, one of them armed with an assault rifle. Biggio was charged with Felony burglary and assault and was issued a restraining order in that case. He had also threatened another owner at area 420 and was at that time, also subject to a protection order against the owner of Miracle farms and his entire family. Biggio had committed perjury on his application for the protection order against myself. He checked a box stating he was under no protection orders himself when he knew full well that he was under 2 at that moment.

I attended the hearing for the permanent protection order in late September in Salida which is in Chaffee county. Biggio was too scared to appear as he knew I had discovered his history etc. I explained my case to the judge and she dismissed the protection order WITH PREJUDICE, which she explained to me that the fake death threats could NEVER be used to get another protection order against me in future. 

Things quietened down as our lawsuit rolled on. Then on December 8th (unbeknownst to myself) Biggio went to a different county Saguache and applied for another protection order using the same debunked death threats that he knew were not supposed to be used again. Fortunately for me, the judge spotted that there was no evidence that I had sent any threats. He said that he would not issue protection orders 'willy nilly' and denied Biggio's application. I discovered this later and have copies of the application as well as a transcript of the hearing. 

I went to the UK on the 9th December to see my children who live there and my sick father. During this time I was having marital difficulties, due in no small part to this extremely stressful legal battle. In my absence Biggio and his partner Justice pounced on my wife Pamela. They convinced her that I was going to have her killed. Biggio sent my wife over 600 texts and had numerous phone calls with her whilst I was abroad. Justice who had never spoken to my wife before) sent her over 200 texts and also had telephone conversations. The theme of many of these calls and texts was that I was going to have her hurt or killed and she needed to file for divorce from me. My wife was under extreme pressure at this time and having a mini breakdown herself. I was also having a breakdown. This is the damage these people had done to us. Biggio went so far as to pay $5000 for an attorney so my wife could file for divorce and another $3000 on top so she could file for a protection order to have me removed from my home. They figured this would weaken me to the point of making me drop the lawsuit they knew they were certain to lose.

An sample of Biggio's texts to my wife is below. You can see just what he was planning by the texts alone. You can see just how sick and twisted these people are when Biggio said that his business partner suggested paying the process server (who was serving me with their desired protection order to make me homeless) an extra hundred dollars to snap a picture of my face when they served me. And he added they should make a video of it so he could put a soundtrack on it. They think its one big joke. Lets see how much these a$$holes laugh shortly when all this catches up with them and they are staring at the four walls of a prison cell (which Biggio is more than used to already). I have it on good authority that its simply a matter of time. They are nothing but pond life in my view. No normal human being would act in this way. And they have to cheek to accuse ME of harassment. 

Below are a sample of the many texts he sent, pushing and pushing my wife to divorce me and file for a protection order to make me homeless. They did not give a crap about my wife, they just cared about destroying me to help the civil case which they knew was doomed to fail . When he discovered his plan has failed he sent another text telling her how disappointed with her he was and that he was going to sue her to recover the $8000 he had spent on the attorney. Remember, she did not ask for the $8000, he kept pushing her to let him pay it so he could make be homeless and destroy my marriage. He thinks money can buy everything, he is sorely mistaken. It cannot buy ethics, morals, class, empathy or honesty. All those have to come from within. Those are qualities which are sorely lacking in these people.

And below are many of the messages Biggio sent to my wife intimating that I was going to have her killed. Him and his partner Justice also told my wife the same thing on the phone many times. They terrified the life out of her, even telling her I could have given my house keys to Erik Martinez, Biggio's pretend hit man and coincidentally the same guy he was facing felony charges for attacking in the video below. Complete and utter bullshit, just to convince her to divorce me and get the protection order they were so desperate for to make me homeless. Fortunately for me, my wife started to realize their ulterior motives shortly before I returned home. She played along with them but decided not to get the protection order as she knew that I had never threatened to cause her physical harm, nor would I

Below is the worst text he sent in my eyes. He had her so terrified that she would be murdered, even telling her to carry her gun everywhere and to park in open spaces. All this crap just to convince her to divorce me and get the protection order making me homeless. All to win his shitty court case because he tried to steal my investment. This guy is a complete low life piece of shit. I will never forgive him for the mental stress he put my wife through with his over 600 texts filled with bullshit along with the 200+ texts sent by his business partner Justice. I hope he ends up back in prison which is clearly where he belongs . 

I returned to the USA on the 31st December 2022. My wife immediately told me exactly what Biggio and Justice had done. We reconciled straight away. My wife has recorded some of Biggio's calls which will be used in our case. 

Since launching my blog website, I had been contacted by many other customers of Potch LLC who felt they had been ripped off or let down on various promises, mostly power. They were not as fortunate as me to have written the power clause in their purchase contract. Many of Biggio's promises to them had been verbal. When they discovered they had been let down, Potch threatened to sue them for future payments. In some cases they made them sign over their deed in lieu of foreclosure and took the land back to resell to the next unsuspecting victim. Many families dreams were shattered due to Potch's lies. Some lost their life savings, others went deeply into debt. 

I emailed both Biggio and Justice on the 8th January, I told them to stay the F*ck away from myself and my family. I also told them to stick to the law in future and stop making false complaints. Less than 18 hours later Justice made a false complaint to Alamosa Sheriff saying I had threatened to snap my fingers and unleash the Sheriff on her like an attack dog. This false complaint led to me being issued with a citation for 2nd degree misdemeanor harassment. I will delve deeper into this issue at the conclusion of those legal proceedings.

Some weeks later I received yet another protection order, this time against Whitney Justice. She had obtained it using the same fake death threats from the previous September. She made a big deal of her being terrified of me, that I was stalking her, and complaining about my website blog. I had only emailed Justice once since our dispute began, simply telling her to stay away from my family and to try to stay within the law in future. I did not call her. I did not text her. I did not follow her. In fact I did not even see her. I had only seen this woman about 3 times in my life. This protection order was from Pitkin County where Justice resided. 

On the 31st January, I made the 6 hour drive to Aspen to appear at the permanent protection order hearing. Justice appeared via zoom but her attorney appeared in person. Justice spouted her story again about her being terrified of me, playing the victim once again. I was then given the chance to cross examine Justice before putting on my defense. I spent over 2 hours cross examining her. I am not an attorney, I have no legal training. I simply had the truth on my side and lots of evidence to back it up. I had taken over 100 sheets of evidence to the hearing. Justice told many lies during the hearing and I kept catching her out on them. It got so bad that her own attorney was shouting at her telling her to shut up.. Importantly I asked Justice at what point I had threatened her with the Alamosa Sheriff. She stated that I had threatened to set his swat team on her. I read the section of my website that she was referring to and it stated. "So I'm not worried about these gangsters threats. Also, The county Sheriff is my neighbor. He has SWAT teams ready at a moments notice. SWAT teams eat thugs with assault rifles for breakfast.". 

I explained to Justice (and the Judge) that this threat clearly referred to thugs with assault rifles and that unless she was a thug with an assault rifle then the threat certainly was not aimed at her, a fact she was well aware of. Also that at no time had I threatened to snap my fingers and unleash the sheriff on her like an attack dog. All mine and Justices communications for the past almost 3 years had been in writing so of course her claims were false. The judge fortunately saw though her BS and realized that the only thing Justice was concerned about was my website blog. The judge also noted that there was not a shred of evidence that I had sent any death thereat. Just before I was about to put on my defense, the judge stated to me that it was my right but that the plaintiff had to prove their case was 51% likely true. She said they had not met that low burden I had no need to put on my defense. She then made a ruling noting that Justices only real complaint was about the website and that this was a matter that should be dealt with in our civil case in Saguache. She then dismissed the protection order. 

So, since out dispute started, I have never threatened them in any way. Nor have I contacted them in any way apart from the 8th January to tell them both to stay away from myself and my family. Despite this, they have fabricated death threats from me, made many fake complaints to law enforcement and judges in many counties. All in a desperate attempt to have them force me to remove my completely 1st amendment protected website blog. 

I had told these people many times on my blog that if they tell lies about me, they can expect me to tell the truth about them. That is why you are now seeing this new blog appear. I'm sick of their illegal stunts and am pushing back hard. They could have settled this dispute for a couple of hundred grand back in August 2023. Instead they went for broke and tried to steal my $1.8 million investment. They are trying everything in their power, every illegal act possible to force me to remove my blog which clearly exposes their antics and is jam packed with corroborating evidence. They know they are doomed to lose the civil case which is why they are doing their best to damage or destroy me forehand. In addition to the many false complaints they have made about me, they also paid $8000 for my wife to divorce me. This is how they treat one of their best customers who had spent $400,000 with them and done nothing wrong apart from believe their BS. 

My blogs are fully 1st amendment protected. The only recourse they have is in the civil courts, which judges keep telling them but they choose to ignore. The only way my blogs ever come down is if they stick to their promise and resolve my power issue, or reach an 'amicable' settlement and stop ripping people off. Failing that, I am expecting an award of around $2 million in our civil case. This will be for breach of contract, damages for the breach and the theft, plus loss of 2 years earnings, plus interest. Once I prevail at court which is an absolute certainty, then my sites will stay online forever. Every single person who has read my main blog and is not affiliated with Justice, Biggio or Potch, has stated that I am sure to win my case. I simply have way too much evidence to meet the low civil bar of 'more probable than not'.

I’ve had a gutful of this pair of rogues lies, BS and false accusations.

For months these people have been:

• Making false complaints to law enforcement and judges about me
• Telling Lies about me
• Trying to destroy my Marriage
• Trying to make me homeless
• Telling others that I am lying, and my website is false and defamatory
• Continuing their acts unchecked and with no consequences

They have had many chances to stop, but they continue this behavior unabated. Nobody gets away with hauling me before a court to face false criminal allegations. They picked the wrong victim this time.  So, in addition to my civil lawsuit against their company Potch in Saguache County, I have now filed a lawsuit in Alamosa County against BOTH of these individuals for the following

1. Malicious Prosecution

I have only filed 20 exhibits with the complaint. But I do have around 100 in total for the disclosure and the trial, plus many witnesses. I have 100% proof of all my allegations. I don’t make BS allegations like this pair do almost on the daily. 
Justice and Biggio have now both been served summonses by Pitkin County Sheriff for Justice and Saguache County Sheriff for Biggio. It’s time we got all this stuff out in the open and in front of a judge and jury. I want the Alamosa Judges to see the real story, not the BS one Justice keeps spinning to them via zoom and her BS allegations and ‘victim’ impact statements. No more BS false allegations from this pair of liars. It is time they were bought to book for their own personal acts as well as their own companies acts. I have prepared the lawsuit myself (with legal advice of course) and will bring a lawyer into the case as it progresses. I am quite capable of taking on any lawyer for now, as I have truth on my side. Also, a huge pile of evidence, texts, emails, audio and video recordings and a stream of witnesses willing to tell the truth in court, under oath, about this pair.

I had someone file a baseless lawsuit upon me many years ago for breach of contract. Their top shelf attorneys had offices not only throughout the USA but also around the world. I had no legal representation. I filed a counterclaim for defamation. The opposition sent two or three high powered lawyers to each and every hearing. I drafted and filed all the responses and motions myself. I stood there alone at the podium. Without any legal training and just solid evidence to counter their lawsuit with. 

They tried their hardest to have my defamation claim dismissed. I proved to the judge that it had merit to proceed. Once the judge ruled in my favor, the other side settled and withdrew their lawsuit. I did not have to pay a penny.
The stated rule is that “Pro Se” litigants must follow the same rules as lawyers. In practice, pro se parties get some more latitude in matters of form and content, i.e.… judges exercise their discretion to overlook more mistakes. If these people do manage to get any counts dismissed on a technicality, I shall refile those counts in a new lawsuit if required. 

See how strong my lawsuit (below) is when drafted by myself? Imagine how much bigger a punch it will pack when the attorney takes over, especially when he destroys this pair in court. I’m looking forward to the cross examination by their attorney’s. When you have truth and evidence on your side, these lawsuits are a whole lot easier to navigate. I’m looking forward to catching this pair out on countless lies. 
I’m a firm believer that truth and evidence always win the day in court. That is why Justice and Biggio have failed in every attempt with their protection orders, even with their false criminal charge. I’m happy to submit all my allegations and evidence to the court and get it all down on public record. Why? Because it’s all true. Notice how Biggio and Justice throw allegations around to all their friends and enemies but never submit these to the court Because the allegations are BS and they know they will get into trouble for doing so. 

Now it’s time to put them in front of a jury personally as well as their business. 2 separate cases for 2 separate lots of despicable acts. They can file any baseless counterclaim they see fit. I’ll just prove, with ease, that it’s more lies.
There are two main reasons for me filing this extra lawsuit. Firstly, it is to expose these pairs lies and insults and hold them accountable. They lie to people, about people, insult people and steal from people. They have done it for years without consequences. Now it’s different. The second reason is that these lies, threats, insults, theft etc, will now be on public record forever. Every time an attorney does due diligence to these people or their company, they will find the business case ref 2023CV00021 (Saguache County) and this personal lawsuit ref number 2024CV7 (Alamosa County). It will be memorialized for years to come on public record for any who wishes to view it. They can even use the contents of these lawsuits to prove ‘prior bad acts’, should they wish to launch their own lawsuit against Biggio, Justice and or Potch LLC.

These people spend their whole days battling people, threatening people, lying about people and taking advantage of people. They have done this crap for years, at least dating back to 2018 to my knowledge. The time has come for this to stop. Justice is so bloody entitled; she thinks that rules and laws are for those beneath her. Biggio is nothing but an ex-con with money who thinks he can buy his way out of every jam he gets into. They lie with impunity because they are not used to people calling them out on those lies. They are about to discover that they can and will be held to account for a change. I am determined to show these people up, in court on public record, for exactly what they are. Every illegal act they do or false complaint they make against me going forward, will be added to either my Alamosa Personal lawsuit or my Saguache Business lawsuit.
